What to Expect During Probate in Nevada

Probate is the process used to settle an individual’s estate, which includes their debts, assets, and real estate holdings. According to Nevada probate laws, this process is conducted by a district court in the county where the decedent lived at the time of their death.

When an individual dies, their representative must present the decedent’s will to the court clerk within 30 days of death to begin the process. The court will review and verify the validity of the will and oversee that debt payments are made and ensure assets are distributed properly. Depending on the value of the estate and other factors, an estate can be resolved through general probate, summary administration, or special administration.

Asset Distribution for Estates That Do Not Have a Will in Place

Resolving estates that do not have a will presents more challenges and may take longer to resolve. All decisions about succession and the distribution of property and assets are made by the court. While the decedent’s family is typically entitled to inherit, there is a hierarchy applied to eligibility.

The decedent’s spouse and/or children are the first to inherit the decedent’s estate since they are direct dependents. Parents, followed by siblings, are next to inherit the estate if there is no surviving spouse or children. Finally, next of kin may inherit if there are no other family members present.

How Long Does Probate Take to Resolve in Nevada?

Probate can be opened and closed within 10-12 months in the best of scenarios. However, it can take much longer if the will or estate is contested, or if no will exists. In these situations, it can easily take a year or more to resolve probate. To reduce the time it takes to settle an estate, you should hire an experienced lawyer who can navigate complications and make sure all requirements are fulfilled correctly.
